PURPOSE
The following Rules and Regulations were established to govern the use of the Villa St. Croix
common area and facilities, and to define standards of personal conduct for all members of the Association. These Rules and Regulations are intended to implement and expand the Association’s Covenants, Conditions and Restrictions, and are not intended to violate or supersede them in any way. Compliance to these Rules and Regulations is deemed in the best interest of the Association and all its members.
APPLICABILITY
All present or future homeowners, tenants, or guests that reside within the Villa St. Croix development, or use the facilities of the Association in any way, are subject to the rules set forth below, in addition to the Covenants, Conditions, and Restrictions (CC&R’s).
HOMEOWNER RESPONSIBILITY
Each homeowner is responsible for the action of all their family members, as well as their renters/tenants and guests. The homeowner is also responsible for informing them of all Rules and Regulations of the Association. It is the responsibility of each landlord to give each new tenant a copy of the rules and regulations.
Homeowners are responsible for maintaining all personal property visible from the common area in a neat and orderly manner.
Homeowners are expected to refrain from noisy activities that are bothersome to adjacent neighbors. Excessive noise will not be tolerated at any time of the day or night as all residents have a right to the quiet enjoyment of their unit.
Common Area
- Please be respectful of your neighbors’ rights and keep noise levels to a minimum. This includes audio equipment, TV’s, loud conversations, etc. Outside games in front of units are not allowed.
- All common areas should be free of personal items such as bikes, toys, or storage. Common areas also include outside the front doors. Please keep items such as ladders, surfboards, etc. that are stored on the balcony out of view from the common area. Tiki torches are not allowed.
- Drinking of alcohol in common areas is prohibited. The exception to this is the clubhouse and pool area.
- Please slow down when driving throughout the complex. We have had complaints about homeowners driving excessive speeds within the complex. Homeowners/residents that are identified speeding over fifteen (15) miles per hour within the complex will be fined. We will fine homeowners/residents $100 who are in violation of this rule.
- Vehicles may not enter the complex through the side exit gate or when the gate opens to allow autos to exit.
- The gate code is not to be given out. This code is intended for vendors only. However, some people are using the gate code, giving it to visitors, and have even posted it on the gate. This is a violation of the Rules and Regulations of the community. The Board will continue to change the vendor code on a regular basis.
- Please use the pedestrian gate when walking in and out of the complex. This will help conserve the life of our gate motors, which so often break down.
- Tampering of any gates (entry, pedestrian, or exit) is not allowed and considered vandalism. Fines will be assessed and the violating homeowner will also pay for the repairs.
- Jumping over the walls, bushes, or gates to enter the complex is not allowed.
- Be sure to put trash in trash bins. We are once again witnessing residents discarding trash on the decks in the trash areas. This is not allowed and violators will be fined.
- Bicycles must not be chained to trees, fences, or stairs. Bicycles need to be operational without flat tires and should be stored in the bicycle racks at either end of the complex. Non-operational bicycles will be discarded.
Children under 18 years of age riding bicycles are required by law to wear helmets. This law also applies when riding bicycles in the complex. - Please remember that children must be supervised at all times in the common area.
- No skateboarding, bike riding, or scooters (razors) on walkways. Children using golf balls, hitting baseballs, using soccer balls, or any type of ball playing, is not allowed. This is a liability issue as it can cause injury or damage to persons, vehicles, or buildings (i.e. windows.) Electric toy cars may not be used within the carport or recreational parking lot.
- Jumping gyms for children’s parties are NOT allowed in the common area.
- Residents may not plant their own plants in the common area. Personal trinkets, ceramic rocks, Malibu lights, solar lights, etc. are also not allowed in the common area.
- Satellite dishes may not be installed on the tile roof. Architectural approval must be obtained prior to the installation of satellite dishes, windows, or doors. Contact the management company for an architectural or satellite application.
- Storage beneath the stairways is not allowed. This includes bicycles, toys, basketball hoops, etc.
- Please observe the 72 hour parking rule. Vehicles may not remain in the common area or carports longer than 72 hours without being moved. All vehicles parked in the carport must have current registration tags and must be operational. Storing vehicles with expired tags is not allowed in the common area or carports.
Non-operational vehicles are considered storage and are not allowed.
Carports are for parking cars not for storage or working areas. (See parking rules.)
With the exception of speeding, residents in violation of these rules will be fined $75.
Speeding carries a fine of $100.
Dumpsters
Be sure to put trash in trash bins. We are once again witnessing residents discarding trash on the decks in the trash areas. Also noted has been trash left outside front doors, which is common area. Leaving trash outside front doors is not allowed since it looks unsightly and attracts ants and rodents.
- Only trash is allowed in the trash bins. Boxes of any type must be broken down. Furniture,
mattresses/box springs, construction material, carpeting, refrigerators, washers, dryers, etc., are not allowed to be thrown in or around the trash bin areas. Landscaping debris may not be thrown in the dumpsters. - Please contact the management company or the trash company to make arrangements to discard any large items. The Board has had to pay a handyman to remove trash from the bins so that the disposal company could empty the bins. In those situations, the homeowners/residents will be fined, in addition to being assessed the cost of the handyman to discard the items.
Residents in violation of these rules will be fined $75.
Patios
- Patios must be kept clean of dog defecation. All feces should be cleaned daily since this can become a health issue if not removed. Upper units should not hose feces from their patio allowing it to run into gutters or patio units below.
- Patios should also be kept neat and clean. Excessive debris brings the value of the property down. If storing surfboards, ladders, etc. on the patio, please keep them out of sight. No appliances or large items on the balconies or patios. Per the insurance company, wood burning stoves/fire pits/Tiki torches are not allowed.
Residents in violation of these rules will be fined $75.
Storage
- Article 7, Section 1 of the CC&R’s states that all garage carports shall be used solely for the
purpose of providing parking spaces for automobiles and shall accordingly be kept and
maintained to accommodate an automobile in each carport space at all times. - Carports are to be used for operable motor vehicles only as defined by the CC&R’s.
- Storing or chaining bicycles in the carport area is not permitted. Please use the bicycle racks at either end of the complex.
Towing
Towing of unregistered and/or non operational recreational vehicles will be at the owner’s expense, and a fine will be assessed for non-compliance of the rules.
Residents in violation of this rule will be fined $100.
Parking

Recreational Vehicles
- Recreational vehicles (boats, campers, trailers, jet skis, etc.) must be kept in the side parking lot designated for those vehicles and registered each year with TPMS, Inc.
- All recreational vehicles must be operational and registration tags must be current. In addition, the Board is now requesting proof that the vehicle being parked in the RV lot belongs to the occupant of the unit. Therefore, a Certificate of Ownership for the recreational vehicle must be provided to the management company as proof that the owner resides in Villa St. Croix.
- Only recreational vehicles may be parked in this area. The vehicles will be assigned a parking space. Please make sure you use only one parking stall per vehicle, and do not double-park even momentarily.
- People may not congregate in the RV lot. Loitering or game playing is not allowed in this area. Electric toy cars may not be used in the carport or recreational vehicle parking.
- Once again, it is important that recreational vehicles be registered with the management company because people that do not reside in Villa St. Croix have illegally used this lot to park their vehicles.
Residents in violation of these rules will be fined $75.
Pool
SWIM AT YOUR OWN RISK. THERE IS NO LIFEGUARD ON DUTY.
- Pool hours are Sunday-Thursday 8:00 a.m. – 9:00 p.m. and Friday and Saturday 8:00 a.m. – 10:00 p.m.
- Please remember that small children must be accompanied by adults, and supervised at all times. Residents must accompany their guests when using the pool facilities. For safety reasons, no one under the age of 16 is allowed in the pool area without an adult.
- Please keep pool gates and bathroom doors closed behind you.
- Keep noise levels to a minimum. Please be respectful of surrounding units. NO LOUD PARTIES OR LOUD MUSIC. INAPPROPRIATE BEHAVIOR IS NOT ALLOWED IN THE POOL AREA.
- DO NOT FEED THE DUCKS. The ducks dirty the pool and deck. Feeding the ducks is also drawing rats to the area.
- Remember that PETS ARE NOT ALLOWED in the pool or poo] area. ($250 fine)
- Toys should not be left in the pool area. NO bicycles, skateboards, razors, wagons, etc. in the pool area.
- All residents must accompany their guests while at the pool. Up to six (6) guests are allowed per unit. If you cannot accompany your guests, they are not allowed in the pool area. Please do not give your guests a key to use if you are not at home or cannot go to the pool. This is not allowed. You will be fined and the key taken away.
If you are planning to have a large party at the pool, please contact the management company for approval. - No glass of any kind is allowed in the pool area.
- Barbecue grills are not allowed in the pool area.
- Please remember that swimming lessons at the pool are not allowed. If someone were to be injured, the association could be held liable. Our insurance does not cover private or group swimming lessons.
- A lost key will be a cost of $100.00.
With the exception of pets in the pool or pool area, residents in violation of these rules will be fined $100.
PETS
- Dogs must be on a leash at all times.
- Our landscaper has complained that there is an excess amount of dog defecation left on the grass area. Please be sure to pick up after your own pet.
- Once again, PETS ARE NOT ALLOWED IN THE POOL AREA or in the pool. This is in violation of the health code.
- Residents are not allowed to leave pet food outside of their units or in the carport areas for pets or stray animals.
- Excessive barking of dogs will not be allowed.
- Dogs may not be tied to common area trees, fences, stairs, or any common area structures.
- All dogs must be registered in accordance with local laws and display the required tags, and the owner’s current address must be updated with the licensing agency.
- Not more than two (2) pets are allowed per unit.
RODENTS
Please do not leave pet food or treats of any type outside, especially overnight. Please also do not feed wildlife animals such as birds (seagulls and crows), squirrels, or stray animals as this contributes to rodent activity.
Persons in violation of any of the above rules will be fined $75 for the first offense and $250 for subsequent offenses.
ARCHITECTURAL
Please remember that all exterior improvements must be submitted for approval by the architectural committee. Please contact TPMS for an architectural form for the installation of windows, doors, screen doors, satellite dishes, fencing, water heater doors, etc.
Clubhouse Rules
Reservation – General
A. The reservation of the clubhouse is restricted to Association members for personal and private parties. Request for the use of the clubhouse by outside organizations, whether or not requested by an Association member, will not be granted. Dance lessons are not allowed in the clubhouse. Our insurance does not cover any type of private or group lessons in the common area or the clubhouse. Application for reservation should be made by calling TPMS at (714) 557-5900 two (2) weeks in advance of the event.
B. Reservation of the clubhouse does not include the exclusive use of the pool and spa. The swimming pool and spa may be used. However, other homeowners and guests may not be excluded from the pool area. There will be no exclusive rights for use of the pool and spa areas.
C. Regularly scheduled Association functions have priority for reserving the clubhouse for open dates.
D. Application for reservation of the clubhouse must be made by a homeowner, and the applicant must be present during the period the clubhouse is in use under such reservation.
E. Complaints, recommendations or suggestions regarding the clubhouse are to be submitted in writing to TPMS, 1536 E. Warner Avenue, Santa Ana, Ca. 92705-5474.
F. There is a non-refundable rental fee of $75 for the use of the clubhouse. A $300.00 security deposit will be held and refunded pending the inspection of the clubhouse after its use. Please refer to the responsibilities below.
Reserving Member’s Responsibilities
A. Clubhouse cleanup as listed below must be done no later than 10:00 a.m. the day following the function:
- Vacuum all carpets
- Dust table and clean counters
- Clean cabinets. Dust and mop all floors
- Empty all trash in the dumpsters
B. In the event of glass door and/or window breakage, it is the responsibility of the homeowner to immediately arrange for boarding up of broken areas to protect the premises from possible vandalism or animal and weather damage. Also, homeowner is to have the glass replaced and pay for it.
C. No barbecuing in the pool area. Eating and drinking are to be confined to the clubhouse premises.
D. NO SMOKING IS ALLOWED IN THE CLUBHOUSE.
E. All doors must be locked and lights turned off when occupants leave the premises.
F. All furniture, if rearranged, must be replaced to its’ original positions. Furniture must not be removed from the interior of the clubhouse.
G. COMMON COURTESY FOR SURROUNDING NEIGHBORS SHOULD PREVAIL WITH RESPECT
TO THE LENGTH OF PARTIES AND TO THE NOISE GENERATED BY GUESTS AND ENTERTAINMENT.
H. The clubhouse key must be returned by 11:00 a.m. the following day.
Mylar balloons are not allowed in the clubhouse. Pushpins, staples, or tape should not be used on the clubhouse walls.
